moses is operated by Antiplastic Inc. ("moses," "we," "us" or "our"). This policy explains how we collect, use and share personal information through moses.com, our shopping and patient intake services, and our communications with you (the "Services"). It also explains your choices. Our store is powered by Shopify.
This policy describes our data practices. It does not replace a separate authorization required to obtain your dental records, or consent required for a particular use of your information.

To arrange and make a custom retainer, we collect information you provide during intake and support, and records your dental provider sends with your authorization. This can include your dental scan or model, provider details, treatment dates, retainer history, a record of your authorization, and information about fit or replacement needs. Quiz responses may also contain information about your dental history or product needs.
We use this information to request and assess your scan, coordinate with your dental office, make and deliver your retainer, arrange refills or remakes, and answer your questions. We keep relevant records to support these services and meet applicable legal obligations. Canceling a subscription does not automatically delete these records.
Relevant information is handled by our team and the providers who support these services, including dental providers, manufacturing and fulfillment providers, hosting and storage providers, and customer-support systems. The information each receives depends on the task it performs. Your dental provider also has its own privacy obligations and notices.
Depending on the law that applies, dental scans, treatment information, quiz answers and information inferred from your interactions may be sensitive personal information or consumer health data. You can contact ask@moses.com to request access, correction or deletion, or to withdraw consent where processing relies on consent. We will explain if a request affects our ability to make or replace your retainer or if a legal exception applies.

Our website and purchasing process are intended for adults. A parent or legal guardian may order for a child and provide the information needed to fulfill that order. We use cookies, pixels and similar tools to operate the store, understand how people use our services and measure advertising. Depending on the service and your choices, these tools can process identifiers, device information, page visits, interactions and transaction events. Our intake analytics can also process quiz responses to help us understand and improve that flow.
Some advertising disclosures may be considered a sale, sharing or targeted advertising under applicable privacy law, even where no money is exchanged for the information. Subscribing to marketing is separate from receiving order and patient-coordination messages.
We use the hCaptcha security service (hereinafter "hCaptcha") on our website. This service is provided by Intuition Machines, Inc., a Delaware US Corporation ("IMI"). hCaptcha is used to check whether user actions on our online service (such as submitting a login or newsletter signup form) meet our security requirements. To do this, hCaptcha analyzes the behavior of the website visitor based on various characteristics. This analysis starts automatically as soon as the website visitor enters a part of the website with hCaptcha enabled. For the analysis, hCaptcha evaluates various information (e.g. IP address, how long the visitor has been on the website, or mouse movements made by the user). The data collected during the analysis will be forwarded to IMI. hCaptcha analysis in the "invisible mode" may take place completely in the background. Website visitors are not advised that such an analysis is taking place if the user is not shown a challenge.
Data processing is based on Art. 6(1)(b) of the GDPR: the processing of personal data is necessary for the performance of a contract to which the website visitor is party (for example, the website terms) or in order to take steps at the request of the website visitor prior to entering into a contract. Our online service needs to ensure that it is interacting with a human, not a bot, and that activities performed by the user are not related to fraud or abuse. In addition, processing may also be based on Art. 6(1)(f) of the GDPR: Antiplastic Inc. has a legitimate interest in protecting the service from abusive automated crawling, spam, and other forms of abuse that can harm our service or other users of our service.
IMI acts as a "data processor" acting on behalf of its customers as defined under the GDPR, and a "service provider" for the purposes of the California Consumer Privacy Act (CCPA). Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee "perfect security." In addition, any information you send to us may not be secure while in transit.
